Terms and Conditions

1. Scope and Applicability

These Terms and Conditions (“Terms”) govern all purchases, downloads and services offered through this website by Mauro Roncoroni, photographer, Switzerland (“Photographer”). They apply to the sale of physical photographic prints, digital products and photographic services.

Any general terms and conditions of the Customer are expressly excluded and shall not apply, even if the Photographer does not explicitly object to them.

2. Definitions

  • Customer, any natural or legal person placing an order or using the website
  • Products, physical photographic prints
  • Digital Products, downloadable photographic files
  • Services, photographic services provided on request

3. Formation of the Contract

The presentation of products and services on the website does not constitute a legally binding offer. By placing an order, the Customer submits a binding offer to conclude a contract.

The contract is concluded upon written order confirmation or issuance of an invoice by email.

By placing an order through this website, the Customer confirms having read, understood, and expressly accepted these Terms and Conditions. Acceptance occurs by actively ticking the corresponding checkbox during the checkout process.

4. Prices and Payment

All prices are stated in the currency indicated on the website and include applicable Swiss VAT, unless stated otherwise. Shipping costs are shown separately during checkout.

Payment must be made using the payment methods offered on the website. In case of late or failed payment, the Photographer reserves the right to suspend delivery or withdraw from the contract.

5. Delivery

Physical products are shipped to the delivery address provided by the Customer. Delivery times are indicative and not binding.

Digital products are made available for download after successful payment.

The risk of loss or damage to physical products passes to the Customer upon delivery of the goods to the shipping carrier.

6. Right of Withdrawal

The Customer may withdraw from the contract for physical products within fourteen (14) days from receipt of the goods, without stating reasons.

Returned products must be unused and in their original condition. Return shipping costs are borne by the Customer.

The right of withdrawal does not apply to digital products once the download or access has begun, provided that the Customer has expressly consented to the immediate execution of the contract and acknowledged the loss of the right of withdrawal.

7. Warranty

Statutory warranty rights apply in accordance with Swiss law. The warranty period for physical products is two (2) years from delivery.

Minor deviations in color or appearance due to printing or display technology do not constitute defects.

8. Limitation of Liability

The Photographer is liable only for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by Swiss law.

The Photographer shall not be liable for indirect damages, consequential damages or loss of profit.

9. Intellectual Property

All photographs, images and content remain the intellectual property of the Photographer and are protected by copyright.

The purchase of a physical or digital product grants the Customer a non exclusive right for private, personal use only.

In particular, it is strictly prohibited to use the works for commercial purposes, to modify or create derivative works, to resell or distribute the works, to use the works for training artificial intelligence systems or similar technologies.

Any use beyond private display requires prior written consent from the Photographer.

10. Website Use

The website may be used solely for lawful purposes and in a manner that does not infringe the rights of the Photographer or third parties.

It is prohibited to copy, scrape or reproduce website content without authorization, to use the website for fraudulent or abusive purposes, to interfere with the technical operation or security of the website.

The Photographer reserves the right to restrict or deny access in case of misuse.

11. External Links

The Photographer assumes no responsibility for the content of external websites linked from this website. Access to such external content is at the Customer’s own risk.

12. Data Protection and Cookies

The processing of personal data is governed by the Privacy Policy and Cookie Policy published on this website.

13. Force Majeure

The Photographer shall not be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions or governmental measures.

14. Amendments

The Photographer reserves the right to amend these Terms at any time. The version applicable at the time of the order shall prevail.

15. Severability

Should any provision of these Terms be invalid or unenforceable, the remaining provisions shall remain valid.

16. Governing Law and Jurisdiction

These Terms are governed exclusively by Swiss law. The place of jurisdiction is Schaffhausen, Switzerland.

17. Language

In case of discrepancies between different language versions of these Terms and Conditions, the English version shall prevail.

18. Contract Storage

The contract and related order data are stored electronically by the Photographer. Order details are available to the Customer via the order confirmation email.
